Q: Is my vehicle covered by the Louisiana Lemon Law?
A: The Louisiana Lemon Law (La. R.S. 51:1941 et seq.) applies to the following types of vehicles:
1. Motor homes (chassis and drive-train only)
2. Passenger automobiles
3. "Jet skis" or "waverunners"
4. All-terrain vehicles
Q: What makes a vehicle a "lemon"?
A: The Louisiana Lemon Law provides that any vehicle still under warranty that has a defect that substantially impairs the use and/or market value that either (1) has not been repaired after four or more attempts within the express warranty period, or (2) has been out of service by reason of repair for a cumulative total of 90 or more calendar days, is a lemon.
Q: What does the dealer owe me if my car is a lemon?
A: If the repair or service requirements are met, the dealer has the option of either (1) replacing the vehicle with a comparable new motor vehicle, or (2) taking the vehicle back and refunding the full purchase price plus any amounts paid by the consumer at the point of sale plus all collateral costs (such as tax, title and license fees) minus a reasonable allowance for the use of the vehicle by the consumer.
Q: Does the Lemon Law cover used vehicles?
A: The Lemon Law only applies to dealers actively engaged in the business of selling new vehicles that are sold under the original manufacturer's warranty.
Q: How much time do I have to make a Lemon Law claim?
A: The Louisiana Lemon Law requires that any lawsuit against the manufacturer of a vehicle to force the compliance with the Lemon Law must be filed within 3 years of the date of purchase of the vehicle or within 1 year from the end of the warranty period, whichever is longer. If a lawsuit is not filed within that time period, the vehicle owner loses the right to enforce this law forever.
