What is a Contingency Fee?

Most personal injury cases are handled by law firms on a contingency fee basis. This simply means that the fee is contingent upon the result obtained by the attorney. When the client recovers money, whether by settlement or judgment, a percentage of that money, agreed upon at the beginning of the case, is payable to the attorney as a fee. The client owes attorney fees to the attorney only from the settlement or judgment, and does not have to pay attorney fees except from that recovery. At Koederitz Law Firm, the contingency fee is typically a total of one-third of the amount recovered for the client. In the event the attorney incurs out-of-pocket expenses for the client, such as deposition fees, charges for copies of medical records, etc., those costs are also due from the recovery, in addition to the fee. The client owes nothing back to Koederitz Law Firm for expenses incurred, unless they are payable from a recovery in the case. Unlike many other law firms, Koederitz Law Firm does not charge clients anything for photocopies, postage, long distance telephone charges, or mileage expenses incurred. A copy of our written agreement with the client is provided to each client at the time it is signed.
